This Privacy Statement explains what types of information OMIYA GAMES, LLC and its wholly owned subsidiaries (“OMIYA,” “we,” “our,” or “us“) or our service providers may collect from or about visitors to, or users of, our websites or applications (“you“), and describes our practices for collecting, using, retaining, protecting, and disclosing such information.

This Privacy Statement applies to Personal Information and other information collected by OMIYA about you when you access OMIYA applications that display or link to this Privacy Statement. Unless otherwise specified, this Privacy Statement does not apply to any other products or services or to information collected in any other way (whether online or offline) or for any other purpose. Information we may process about Users is addressed separately in the section below entitled “Personal Information of our Customers’ Users.”

What Personal and Other Information Does OMIYA Collect?

For purposes of this Privacy Statement, “Personal Information” means information that can be used to personally identify you, such as your name, address, telephone number, email address, user IDs and passwords, contact preferences, and similar information.

OMIYA does not collect Personal Information and other information from or about you to share with third parties when you are using this application.

OMIYA may use external services to gather information on your application usage. OMIYA will not share this information with outside parties and only use the information to improve the quality of our Application.

OMIYA may collect Personal Information that you provide to enhance your gaming experience. To the extent furnished by You, the contents of any entry that you post directly to the Application, including any text, images, photos, videos and audio, may be stored and maintained on OMIYA’S servers in order to publish these items and otherwise provide the Application.

OMIYA systems may also associate user information from your activities / use of the Application in the course of providing the Application to you.

When you send email or other communication to OMIYA, OMIYA may retain those communications in order to process your inquiries, respond to your requests, or improve OMIYA’s Application and other developments.

OMIYA uses certain user information to better understand how visitors use OMIYA’S Application. This information is commonly made available by web browsers, cellular towers, GPS, and servers, and may include data about browser type, language preference, referring site, and the date and time of each visitor request.

How Does OMIYA Use Your Information?

OMIYA may use information that we collect from or about you, including any Personal Information to notify you of updates that you have selected in “Settings“, as well as other information.

OMIYA may also process Personal Information for: (1) fulfilling purchases; (2) sending you information related to your account or other Application’s; (3) auditing, research and analysis in order to maintain, protect and improve Company’s Application; (4) ensuring the technical functioning of OMIYA’S network; and (5) developing new Applications.

To assist us with the uses described in this Privacy Statement, information we or our service providers have collected from or about you through OMIYA’s application, or our email communications with you, including about your use of such application, may be combined with or enhanced by other information from or about you that we have obtained from other online or offline sources, including from our service providers or business partners.

With Whom Does OMIYA Share Your Information?

Unless required by applicable law, or court order, OMIYA will not share, sell, trade, or lease your Personal Information to or with others except as provided for in this Privacy Statement.

Despite OMIYA’s policy against the sale or use of Personal Information without user consent, users should be aware that what they share on the Application may be discovered by outside parties without OMIYA’s involvement, including, without limitation, search engine crawlers and bots. Users should always take that into consideration whenever they share anything.

Your Marketing Choices, Right to Access Your Personal Information, Our Retention of Your Personal Information

OMIYA strives to keep your Personal Information accurate and private. We will provide you with reasonable access to your Personal Information in accordance with applicable laws, including by making reasonable efforts to provide you with online access and the opportunity to update your information. To protect your privacy and security, we will take steps to verify your identity before granting access or making changes to your Personal Information. To request access to, or correction, deletion or removal of, your Personal Information, follow the applicable instructions below depending on what is at issue. While we will make reasonable efforts to accommodate your request, we also reserve the right to reject such access requests or to impose certain restrictions and requirements on such requests, if required or permitted by applicable law. We will respond to requests for access within 30 days.

OMIYA will retain your Personal Information for as long as your account is active or as needed to provide you services, or otherwise furnish the Application. If you wish to cancel your account, or request that we no longer use your Personal Information to provide you services, contact us via the applicable information provided below. Even after we cancel your account or cease using your Personal Information to provide you services, we may still retain, use, and disclose your information as necessary to comply with our legal, regulatory, ethical, or document retention obligations, and any request to delete your Personal Information is subject to these obligations and restrictions.

OMIYA’s Application(s) or website(s) may provide links to third-party websites or resources for your convenience and information. If you access those links, you will leave such OMIYA website or Application. OMIYA does not control these third-party websites / resources or their respective privacy practices, which may differ from OMIYA’s. We do not endorse or make any representations about third-party websites. The Personal Information you choose to provide to unrelated third-parties is not covered by the OMIYA Privacy Statement. We encourage you to review the privacy statement of any website, resource, application, or other entity before furnishing the same with your Personal Information.

Security of Your Personal Information

OMIYA has implemented reasonable administrative, technical, and physical measures designed to protect your Personal Information from accidental loss and from unauthorized access, disclosure, use, alteration, or destruction. If a password is used to help protect your accounts and Personal Information, it is your responsibility to keep your password confidential. Please also be careful to avoid “phishing” scams, where someone may send you an email that looks like it is from OMIYA asking for your Personal Information. OMIYA will not request your Personal Information through email.

Information collected by OMIYA may be stored or processed on computers located in any country where OMIYA does business. OMIYA takes reasonable steps to secure your personally identifiable information against the unauthorized access, alteration, disclosure or destruction of data. OMIYA may encrypt transmission of data on pages where you provide payment information. However, no security or encryption method can be guaranteed to protect information from unauthorized access, hackers or human error.

Your California Privacy Rights

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information by OMIYA to its affiliates and/or third parties for their direct marketing purposes. To make such a request, please send an email with your first name, last name, mailing address, email address, and telephone number to OMIYA at support@omiyagames.com. Please include “California Privacy Rights” in the subject line of your e-mail.

Social Media and Refer a Friend

Our applications may include social media features, such as the Facebook ‘Like’ button, and widgets, such as the ‘share this‘ button. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our websites or applications. Your interactions with these features are governed by the privacy statement of the company providing them.

If you choose to use our referral service to tell a friend about a page on an OMIYA application, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. OMIYA does not store this information, except to the extent permitted by law.

Account Information

The OMIYA application does require account registration. To the extent that some of Our features may utilize user accounts to optimize the user experience such accounts comply with verifiable parental consent requirements mandated by the Children’s Online Privacy Protection Act (COPPA). As described in the End User Legal Agreement (“Agreement”), the parent or legal guardian (“Parent”) of each child under the age of 13 must register with OMIYA before accessing the game. Registering an account requires that a child’s Parent provide an email address, a user name for the user and the date of birth of the user. For U.S. residents, after a Parent has registered an account, OMIYA will verify that the child is the Parent’s child by asking for the sum of the first and last digits of the Parent’s social security number and the Parent’s name, date of birth, and street address. OMIYA will not share such information with any third party and such information shall be used by OMIYA only to the extent described in this section. After OMIYA verifies that the child is the Parent’s child, it will ask the Parent to consent to the creation of an Account with us. If a Parent does not consent to a child’s access to and use of the Services or does not verify the Parent’s consent through the consent process, OMIYA will bar that child’s registration for an Account, prevent the child’s access to and use of the Services, and ensure that such child’s information is not accessible through the Services.

Parents have the right to refuse further collection, use, and/or disclosure of their child’s account by notifying us. If we learn that we have received information from a child under the age of 13 without the Parent providing consent, we will delete the child’s Account in conjunction with such Account.

The Parents of children under the age of 13 understand and agree that OMIYA and/or may provide information collected via the Services, to third parties who use such information for the sole purpose of administering or providing the Services (e.g., third party security monitoring services and web hosting companies).

Information Collected Using Cookies and other Web Technologies

Like many website owners and operators, we use automated data collection tools such as Cookies and Web Beacons to collect certain information on our Site.

“Cookies” are small text files that are placed on your hard drive by a Web server when you (or your authorized child) access our Services. We may use both session Cookies and persistent Cookies to identify that you (or your authorized child) have logged in to the Services and to tell us how and when you (or your authorized child) interact with our Services. We may also use Cookies to monitor aggregate usage and web traffic routing on our Services and to customize and improve our Services. Session Cookies are deleted when you (or your authorized child) log off from the Services and close the browser. Persistent Cookies remain on your computer and will identify how you use the Services over time. “Web Beacons” (also known as web bugs, pixel tags, or clear GIFs) are tiny graphics with a unique identifier that may be included on our Services for several purposes. For example, we may use Web Beacons to deliver or communicate with Cookies, to track and measure the performance of our Services, to monitor how many visitors view our Services, and to monitor the effectiveness of our advertising. Unlike Cookies, which are stored on the user’s hard drive, Web Beacons are typically embedded invisibly on web pages (or in an e-mail).

Information Related to Use of the Services

Our servers automatically record certain information about how a person uses our Services (we refer to this information as “Log Data”), including both Account holders and non-Account holders (either, a “User”). Log Data may include information such as a User’s Internet Protocol (IP) address, user agent, browser type, operating system, the web page that a User was visiting before accessing our Services, the pages or features of our Services to which a User browsed and the time spent on those pages or features, search Agreement, the links on our Services that a User clicked on, and other statistics. We use Log Data to administer the Services and we analyze (and may engage third parties to analyze) Log Data to improve, customize, and enhance our Services by expanding their features and functionality and tailoring them to our Users’ needs and preferences. We may use a person’s Log Data and other information to generate aggregate, non-identifying information about how our Services are used and use such aggregated information to understand and improve our Services and to administer use of the Services. If we engage a third party to analyze the Log Data, we will ensure that such third party is bound by contractual Agreement requiring it to process such Log Data in accordance with relevant European data protection laws (including, without limitation, the Data Protection Directive).

Information Sent by Your Mobile Device

We collect certain information that your (or your authorized child’s) mobile device sends when you (or your authorized child) use our Services, like a device identifier, user settings, and the operating system of your (or your authorized child’s) device, as well as information about your use of our Services while using the mobile device. We may use this information to provide the Services and to improve and personalize our Services for you (or your authorized child).

Location services

We may also request access to or otherwise receive information about your device location when you access the Website. Your location data may be based on your IP address. We use location data in connection with providing our Services and to help improve our Services for you.

We encourage you to review this Privacy Statement frequently to be informed of how OMIYA is collecting, using, retaining, protecting, disclosing, and transferring your information.
